Not enough info, but nothing in these photos suggests black bamboo to me.

Do you have any pictures of the shoots? If they are brownish, it could be atrovaginata, and if shoots are reddish, that would make it parvifolia. That shape and overall structure looks similar to those, but having pictures of new shoots gives a better identification.

parvifolia usually has pretty chlorotic leaves and the branches are quite dense (My parvifolia regularly has three instead of two side-branches)stevelau1911 wrote:Do you have any pictures of the shoots? At least in comparison to my atrovaginata and parvifolia the pictures look quite different.
The branches and leaves remind me of my aurea but also look a little bit like aureosulcata, but given that I only have a limited number of boos it is hard to tell from own experience.
I know this is just a random stab given that we have no pictures of shoots but what about phyllostachys nuda? From what I gather its culms can be pretty dark when they are young.
Either way without more pictures and especially pictures of shoots there is just too much uncertainty.

Aren't those new leaves just unfolding so the size/shape is not yet apparent?
Nuda was my first thought as well based on the duskiness but it seems that on the French forum I see Viridiglaucescens looking the same and it is very common in Europe. I am doubtful if the true form is in the US, I tried multiple nurseries that claim to sell it and none seemed proper to me. Too bad it looks like a fine bamboo.
